Article 1 – Definitions

  1. User: every visitor of the virtual domain
  2. Customer: a User of the virtual domain who purchases a Product via the Platform.
  3. Purchase Agreement: the agreement between a Partner and a Customer via a purchase of a Product of the Customer from a Partner via the Platform.
  4. Website: fairbee.com (an online magazine and webshop)
  5. Entrepreneur: Fairbee B.V.
  6. Partners: a third party, being a private or limited liability company that offers its conscious Product via the
  7. Platform: the Website on which Partners offer their Products to Users.
  8. Product: an item offered on the Platform.

Article‹ 3 – Applicability

  1. These General Terms and Conditions are applicable to every purchase and sale of Products of Partners via the Platform. The General Terms and Conditions are available on the virtual domain.
  2. Every Customer which orders an item on fairbee.com, accepts these General Terms and Conditions.
  3. In priciple deviations from these General Terms and Conditions are not possible, unless parties agree in writing for which part of these Terms and Conditions the deviation applies, leaving all remaining articles to still be applicable.
  4. The General Terms and Conditions are applicable to all types of Customers.
  5. All rights and claims in these General Terms and future agreement applicable to the Entrepreneur, stipulated for the benefit of the Entrepreneur, will be stipulated to other intermediairies or third parties and in particular the Partner(s)).
  6. Entrpeneur has the right to amend the General Terms and Conditions from time to time, which amendments will be applicable at the moment they are published on the Platform. Every User who places an order, accepts the amended General Terms and Conditions. Therefore please check the latest General Terms and Conditions before placing an order.

Article 4 – Customer account

  1. Customer has to meet the following requirements:
    1. Customer must have reached the age of 18 years and be legally competent;
    2. Customer must have a valid e-mailaddress;
  2. Customer could register and open a Fairbee-account on the Platform, however this is optional and the Customer is able to place an order without registration;
  3. The Entrepreneur is at all times entitled not to process certain orders for Products from Partners or to attach conditions to it.
  4. Customer is responsible for the use of account and the associated username and password. The Customer is advised to create a unique password and  to keep it secret. The account is personal and the Customer is therefore not allowed to let others use his account.
  5. Customer declares to act in accordance with the General Terms and Conditions and all applicable laws and regulations.
  6. Customer is responsible for the correctness of the data on his or her account.

Article 5 – Supply of third parties (Partners)

  1. The Customer acknowledges that a Purchase Agreement is being concluded and that the Entrepreneur is and/or will not be a party to this agreement.
  2. For questions and/or complaints about the Partner Products purchased by the Customer, the Customer may at any time address the relevant Partner or contact the Partner via Fairbee’s customer service. The Customer thereby acknowledges that the Entrepreneur is in no way liable, including but not limited to any defectiveness of the purchased Product.

Article 6 – Order and Delivery

  1. The Customer’s ordering process runs through the Entrepreneur’s Platform, where the Partners offer their Products.
  2. The Customer will receive a packing slip from the Partner in the packaging of the delivered Product. If the packing slip is missing, it can be requested at Entrepreneur’s customer service ([email protected]).
  3. Ownership of the delivered Products only transfers if the Customer has paid the amount due and has not made use of the applicable return period of 14 days after receipt of the Products.

Article7 – Compensation and payment

  1. The Customer owes the purchase price of the Product purchased on the Platform from the Partner to the Entrepreneur and is not released from his payment obligation by direct payment to the Partner.
  2. Payment by the Customer is made exclusively to the Entrepreneur. Partner has irrevocably granted the Entrepreneur the right to exercise the collection rights arising from the purchase agreement between the Customer and the Partner in the name of the Entrepreneur and to the exclusion of the Partner.
  3. Entrepreneur will handle claims against the Customer in accordance with its collection policy.

Article 8 – Provisions for every purchase from Partner(s)

  1. If a Customer purchases a Product from a Partner via the Platform, then:
    • The Customer undertakes to read and agree to the general terms and conditions of sale of the relevant Partner(s) from which he purchases one or more Products via the Platform. These can be consulted at all times via the relevant Partner page on the Platform;
    • An order for a Product will then be processed in accordance with the terms and conditions of the relevant Partner;
    • The Customer is entitled to return an order within the period specified by the Partner in its general terms and conditions of sale (according to the ‘right of withdrawal’) in order to receive a refund of the purchase price.
  2. The Customer must in any case observe the following points and observe the general terms and conditions of sale of the relevant Partner:
  • When returning Products, the Customer must comply with the Partner’s return policy. The contact options, shipping and return policies of each individual Partner can be consulted at all times on the relevant page of the Partner on the Platform.
  • The Customer will return the item to the relevant Partner within 48 hours after the Customer has reported the return.
  • The Entrepreneur then pays the purchase price as soon as possible, but no later than 7 days after the Partner has indicated that the Product has been returned in good order, unworn and undamaged, with any attached price tag and/or stickers, and the Partner accepts the return.
  • If the Customer has made use of his right of withdrawal in the prescribed manner, the costs of return will be for his account. If the Partner also offers to bear the costs of the return shipment, this will be stated on the relevant page of the Partner on the Platform.
  1. If a Partner does not accept an order within two working days, the Entrepreneur will notify the Customer as soon as possible, but no later than four working days after the Customer has placed the order, that this order has not been accepted and will return the payment received.

Article 9 – Information and use of data

  1. Customer is responsible for his e-mail management and therefore for taking cognizance of information sent to the Customer.
  2. Entrepreneur is not liable for late or unclear information or for obvious clerical errors of Partners or third parties or to whom this information is provided.
  3. The Client declares that it is aware of and agrees that its name and address details will be provided to the Partner insofar as this is necessary for the execution of the Purchase Agreement or if the Client has given permission for this. The Partner may only use the name and address details insofar as this is necessary for the execution of the Purchase Agreement or if the Customer has given permission for the use of the data.

Article 10 – Miscellaneous

  1. The Entrepreneur is at all times entitled to block the Customer’s rights or the use of the account or to deny or limit the possibility to order items from Partners via the Entrepreneur, if the Entrepreneur has good reasons for this, the assessment of which is lies solely with the Entrepreneur.
  2. In principle, the Entrepreneur does not deviate from the General Terms and Conditions. Should this nevertheless be the case due to circumstances, this does not affect his right to demand immediate and strict compliance with the General Terms and Conditions. The Customer can never derive any rights from this.
  3. If one or more of the provisions of the General Terms and Conditions are in conflict with any applicable laws and regulations, the relevant provision will lapse and it will be replaced by the Entrepreneur with a provision with a comparable purport in accordance with current laws and regulations.
  4. The website is continuously subject to new developments and updates, which is why the Entrepreneur is at all times entitled to adjust functionalities and the offer.

Article 11 – Applicable law

  1. These General Terms and Conditions are exclusively governed by Dutch law. All disputes between the parties will be submitted to the court in The Hague.
